Difference between CE marking and RD 1215/97 compliance
CE marking is a manufacturer obligation: it certifies that, at the time it is placed on the market, the machine complies with Machinery Directive 2006/42/EC. It is a pre-market requirement.
Compliance with RD 1215/97, on the other hand, is the responsibility of the employer using the equipment. They must ensure the machine remains safe throughout its working life, considering its installation, use, maintenance and any modifications.
That is why a CE-marked machine may still need a compliance study if its installation or usage creates risks not originally considered.
